Individuals of some animal species have been taught simple versions of human language despite their natural communication systems failing to rise to the level of a simple language. How is it, then, that some animals can master a version of language, yet none of them deploy this capacity in their own communication system? I first examine the key design features that are often used to evaluate language-like properties of natural animal communication systems. I then consider one candidate animal system, bird (...) song, because it has several of the key design features or their precursors, including social learning and cultural transmission of their vocal signals. I conclude that although bird song communication is nuanced and complex, and has the acoustic potential for productivity, it is not productive – it cannot be used to say many different things. Finally, I discuss the debate over whether animal communication should be viewed as a cooperative information transmission process, as we typically view human language, or as a competitive process where signaler and receiver vie for control. The debate points to a necessary condition for the evolution of a simple language that has generally been overlooked: the degree of to which the interests of the signaler and receiver align. While strong cognitive and signal production mechanisms are necessary pre-adaptations for a simple language, they are not sufficient. Also necessary is the existence of identical or near-identical interests of signaler and receiver and a socio-ecology that requires high-level cooperation across a range of contexts. In the case of our hominid ancestors, these contexts included hunting, gathering, child care and, perhaps, warfare. I argue that the key condition for the evolution of human language was the extreme interdependency that existed among unrelated individuals in the hunter-gatherer societies of our hominid ancestors. This extreme interdependency produced multiple prosocial adaptations for effective intragroup cooperation, which in partnership with advanced cognitive abilities, set the stage for the evolution of language. This study throws new light on the composition of Boyle's Free Enquiry into the Vulgarly Receiv'd Notion of Nature ; it also draws more general conclusions about Boyle's methods as an author and his links with his context. Its basis is a careful study of the extant manuscript drafts for the work, and their relationship with the published editions. Section 2 describes Boyle's characteristic method of composition from the late 1650s onwards, involving the dictation of discrete sections of text to (...) amanuenses; it also assesses the effect this had on the structure and presentation of Boyle's writings. Section 3 considers the published text section by section and indicates which parts were written when; it also surveys unpublished draft material relating to the work. Section 4 places the work in context, considering the intellectual threats that Boyle sought to confront in it, both when he initially composed it in the 1660s and when he rewrote it c. 1680. It thus anchors him more precisely than hitherto in the intellectual debates of his day. (shrink)

ABSTRACTChildren are often perceived to be less credible testifiers than adults. Their inexperience and affinity for play can provide reason to question their credibility and sincerity as truth tellers. The discrediting of children's testimonial claims can, however, result in an injustice when it stems from an uncritical age-related identity prejudice. This injustice can lead to several consequences varying in severity, with the worst cases leading to their deaths. More commonly, and especially when this injustice is considered in combination with other (...) intersectional identities, it has the potential to render these children invisible. In this paper, we discuss common domains within which children can face epistemic injustice when testifying about their experiences. The heart of the paper explores the most severe instances of epistemic injustices by reviewing three cases where children with intersectional identities died after their testimony was not believed. The paper concludes by emphasizing some of the important considerations that a recognition of intersectionality brings to the current discussion. (shrink)

This paper explores analyzing criminal responsibility from the Humean position that blame is for character traits. If untoward acts indicate undesirable character traits, then the agent is blameworthy; if they do not, then the actor is not blameworthy — he has an excuse. A distinctive feature of this approach is that that voluntariness of acts is irrelevant to determining blameworthiness.This analysis is then applied to a variety of issues in criminal law. Mens supports inferences to character traits, and the Humean (...) approach provides a reason for rejeting strict criminal liability. The Humean approach also helps resolve a number of issues about attempts, such as punishment for impossible attempts and the defense of abandonment. It also supports the broad outlines of the defense of mistake and provides a third alternative in the Wooton-Hart debate over punishment and treatment. (shrink)

Within three of the most well-known contemporary approaches to argumentation, the notions of solo argumentation and arguing with one’s self are given little attention and are typically argued to be able to be subsumed within the dialectical aspects of the approach being propounded. Challenging these claims, this paper has two main aims. The first is to argue that while dialogical argumentation may be most common, there exists individual dialectical argumentation, which is not so easily subsumed within these theories. Second, in (...) order characterize this type of argumentation the paper also offers distinctions between the interrelated notions of dialectical, dialogical, and quasi-dialogical, reasoning and argumentation, within an individual or between multiple participants, which I hope provide useful precision for the field. This paper offers insights into the nature and design of critical questions as they are found in argumentation schemes. In the first part of the paper, I address some general concerns regarding their purpose and formulation. These include a discussion of their evaluative function, their relationship with the patterns of reasoning they accompany, as well as the differing formulations of critical questions currently on offer. I argue that the purpose of critical questions for humans ought to be to provide the (...) means for a scalar evaluation of the reasoning at hand. To do so, critical questions should be closely paired with individual premises in the accompanying pattern of reasoning and be open-ended. Doing so allows the roles of raising considerations relevant for the reasoning and scrutinizing those considerations to be clearly distinguished. In the second part of the paper, I offer a positive methodological proposal for the construction of questions and premises that aims at overcoming a number of the individual and systematic shortcomings of extant question styles. The paper concludes by arguing that the newly proposed approach is both normatively strong and practically useful for argumentation in context. (shrink)

Disagreement has garnered attention in a variety of academic disciplines, but its counterpart agreement is deserving of much more attention than it has received. This paper begins by reviewing some of the existing literature directly discussing agreement. Inspired by these conversations, I then provide a typology of basic types of agreement followed by a more general discussion of its nature. Contemporary argumentation theories highlight the importance of Others for contributing to and critiquing an individual’s reasoning and/or argumentation. Reasoners and arguers are encouraged to interact with imagined constructs such as a community of model interlocutors or universal audience. These model interlocutors are theoretically meant to bring to mind reasons and counter-considerations that may not have been conceived of otherwise so as to improve the overall quality of an instance of reasoning or argumentation. Overlooked, however, is the impact of differing individual’s (...) imaginative abilities. This paper argues that more important than relying on an Other, real or imagined, reasoners and arguers would do just as well to improve their own creative abilities first. Consulting a real or imagined Other may help in some cases help, but such a strong reliance on Others comes with serious limitations. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Philosophy and Literature 25.1 (2001) 171-173 [Access article in PDF] Book Review Literary Lives: Biography and the Search for Understanding Literary Lives: Biography and the Search for Understanding, by David Ellis; ix & 195 pp. New York: Routledge, 2000, $35. In his discussion of biography as a form, Ellis points to his study as a response to the scarcity of "monographs on biography... and [that] none of them are (...) particularly satisfactory" (p. 2). He further points out that "the comparative dearth of analytic enquiry into biography is surprising" (p. 3). In short, his first pages get off to a rocky start in their tatty justification of a critical study. Though a critic of D. H. Lawrence, Ellis uses the English writer sparingly, pointing out in his "Preface" what he feels is a need "to keep illustration involving Lawrence to a decent minimum" (p. viii) while concentrating on those problems which face the biographer. That said, he sets about to characterize biography as an integration of "a disinterested enthusiasm for information... [fashioning a]... compelling story in which many details with no direct relevance to the life of his subject can be considered as contributing successfully to a period atmosphere" (p. 35). Ellis is thinking specifically of Norman Sherry's biography of Graham Greene through which he has brought to the discussion his intent of pointing to an approach which concerns itself with chapters on "Ancestors," "Primal Scenes," "Body Matters," "the Sociological [End Page 171] Imagination," "History, Chance and Self-determination," "Compatibility, Sartre and Long Biographies." All are aspects of biography.As well as the approach he suggests by these areas of concentration, Ellis draws broadly from many subjects of biography, always keeping a critical eye on its form. Anne Stevenson's approach "is towards psychological determinism" (p. 135); Ackroyd in his biography of Dickens raises "through a degree of intellectual play" the questions of when "lineage" is appropriate, that is, the extent to which it has any productive consequence. He also uses Hawthorne and Virginia Woolf as examples. Writing of the role of the historian raises difficulties for writers creating biographies from such an early period as that of Chaucer; Ellis points to Derek Pearsall's "excellent Life of Geoffrey Chaucer" (p. 121).Ellis neither can nor should ignore Lawrence and what better chapter to include him in than "Body Matters" in its concentration on illness. Here Ellis draws on Lawrence's concern with the harm of his health on his work (p. 78). He also considers Flaubert, Sartre, and Woolf. Briefly he mentions Stendhal's imagination of his "future audience" after his death (p. 109), sensibly rejects the long ago depleted and so, parenthetically, apparently permanent speculation on what Keats's might have become had he lived a full life "in a time of drugs for treatment of tuberculosis" (p. 123) and the equally mined issue of what prompted Hemingway's suicide (pp. 132-33). Certainly he is aware of the danger that such a use of material may pander to the pleasure of mere name-hunters (what if there were no index!). At the same time, if the effect of his range of examples invites additions of our own, while keeping before us that his study is about biography as form, it is successful.In "Primal Scenes," the fourth chapter of his book, Ellis gives what he feels is necessary space to Freud, the creator of the term. He points to Wordsworth's "spots of time" as only one indication of the difficulty--if not impossibility--of capturing biographically those moments in childhood by which the individual written about might be defined (p. 57). (Such an impossibility should not be surprising to those of us readers who recognize the nearly impossible task for ourselves in our own lives.) Surely both the biographer and autobiographer share this ignorance and frustration. Many contemporary views, ultimately derived from the Kantian dictum that 'ought' implies 'can', base excuses on the nonvoluntary character of an action. For example, H. L. A. Hart argues that the basic requirements for responsibility are that a person have the capacity and a fair opportunity to do what is (...) required. A person is to be excused for an action if he lacked either the capacity or opportunity to do what was required. As these are conditions for an action being voluntary in a suitably narrow sense, Hart primarily bases excuses on the nonvoluntary character of actions. Likewise, Richard Brandt's view, which in many respects is similar to Hume's, requires that the manifestation of a character trait be subject to a high degree of voluntary control before blame.2 is appropriate. Hume, however, explicitly denies that either a character trait or its manifestation in conduct need be subject to voluntary control for blame to be appropriate. The nonvoluntary character of an action does not necessarily excuse one from blame. Hume makes four key claims about blame and excuse. (1) The ultimate objects of praise and blame are mental qualities, not actions. (2) Actions are considered only as signs of mental qualities. (3) The possession and expression of these mental qualities may be appropriate objects of praise or blame even if they are nonvoluntary. (4) Persons have excuses if their actions do not indicate enduring mental qualities. These points need to be substantiated and explained. The first two claims may be considered together. The external performance has no merit. We must look within to find the moral quality. This we cannot do directly; and therefore fix our attention on actions, as on external signs. But these actions are still considered as signs; and the ultimate object of our praise and approbation is the motive, that produced them. For present purposes, only two points need be noted about this passage. First, it clearly states that the ultimate objects of praise and, as he indicates in his following 4 paragraph, blame are always mental qualities. The expression mental qualities is vague, perhaps deliberately so. Sometimes Hume uses the term motive instead. By 'motive' he does not intend any passing desire or further intention which one may have in acting, e.g., embarrassing others. For Hume, some motives are not even dispositions to act. Second, actions or external performances have no merit. They are only signs of mental qualities. Even if the concept of an action includes more than the external behavior, such as the intention, it does not include motives or desires. A difference in intention may entail a difference in action, but a difference in motive does not. The same action may be performed from different motives. Hence, actions are not logically connected with the objects of praise and blame. Hume's claim that actions themselves have no merit, it might be objected, is incorrect. People do constantly evaluate actions. If they did not, then actions would not be considered untoward and a basis for attributing blame. However, Hume does not deny that actions may be evaluated in some way or other, only that they alone have merit or are appropriate objects of praise and blame. Actions may be evaluated without reference to mental qualities, for example, as right or wrong, useful or unuseful. Hume is 19. chiefly concerned with evaluating actions as virtuous or vicious. The terms virtuous and vicious as applied to actions involve an element of praise and blame, whereas the terms right and wrong, at least in most of their uses, do not. This study compares two uniquely developed tools for engaging undergraduate business ethics students in case discussions: paper-based cases and interactive digital games. The cases we developed address borderline instances of sexual harassment and racism in the workplace and were used to facilitate students’ affective appreciation of the content of course lectures and readings. The purpose of the study was to assess the relative effectiveness of these two tools as teaching aids in increasing affective learning. Pre- and post-test surveys thus focused (...) on affective learning outcomes. These included change in student perceptions of the importance of the topics, feelings of agency, perceptions of improved self-reliance, and confidence. Results showed that digital cases are at least as effective as static cases in terms of their affective learning efficacy, and that digital serious games spur students to reflect on themselves and others more effectively than static cases. An ideal rule-Utilitarian theory is presented which incorporates some of the advantages of those based on accepted rules. The theory attempts to maximize welfare for a society of imperfect men. First an ideal moral code is explicated. Second a principle of a practical moral code is explicated which in effect prohibits violating rules of an ideal moral code except when general conformity to an ideal rule would have bad consequences.

In “Ideals and the Concept of Morality,” John T. Granrose criticizes R. M. Hare’s theory of morals for not providing good and sufficient reasons for rejecting the ideals of fanatics, e.g., Nazis and other racists. He then attempts to do what Hare admittedly failed to do by developing an argument based on a material or social concept of morality. Granrose claims that his argument “wins by default! In the absence of a rational counterargument by the fanatic, the issue is settled”. (...) In this discussion I shall not be concerned with Granrose’s strictures about Hare’s theory. Instead, I shall show that Granrose does not win by default for the fanatic has a rational counterargument. For convenience, I shall confine my discussion to racism as a form of fanaticism. (shrink)

A continuing issue of contract law is what purported contracts should be legally enforced. This article considers what principles rational persons would want courts to use in enforcing commitments in a society in which they expected to live. By reviewing the promise, economic value, and reasonable expectations approaches, the principles of freedom of transfer, enforceable commitments, and collective good are developed. Then, less general principles of consideration, past benefits, reliance, gratuitous commitments, and contract modification are presented. These latter principles specify (...) the more general principle of legally enforceable commitments. The resulting set of principles provide the basic outlines of legally enforceable commitments that would be acceptable to rational persons living in a contemporary, industrialized Western common-law society. In recent years, we have seen a new concern with ethics training for research and development professionals. Although ethics training has become more common, the effectiveness of the training being provided is open to question. In the present effort, a new ethics training course was developed that stresses the importance of the strategies people apply to make sense of ethical problems. The effectiveness of this training was assessed in a sample of 59 doctoral students working in the biological and social (...) sciences using a pre-post design with follow-up and a series of ethical decision-making measures serving as the outcome variable. Results showed not only that this training led to sizable gains in ethical decision making but also that these gains were maintained over time. The implications of these findings for ethics training in the sciences are discussed. (shrink)

We develop a truism of commonsense psychology that perception and action constitute the boundaries of the mind. We do so however not on the basis of commonsense psychology, but by using the notion of a Markov blanket originally employed to describe the topological properties of causal networks. We employ the Markov blanket formalism to propose precise criteria for demarcating the boundaries of the mind that unlike other rival candidates for “marks of the cognitive” avoids begging the question in the extended (...) mind debate. Our criteria imply that the boundary of the mind is nested and multiscale sometimes extending beyond the individual agent to incorporate items located in the environment. Chalmers has used commonsense psychology to develop what he sees as the most serious challenge to the view that minds sometimes extend into the world. He has argued that perception and action should be thought of as interfaces that separate minds from their surrounding environment. In a series of recent papers Hohwy has defended a similar claim using the Markov blanket formalism. We use the Markov blanket formalism to show how both of their objections to the extended mind fail. The life–mind continuity thesis is difficult to study, especially because the relation between life and mind is not yet fully understood, and given that there is still no consensus view neither on what qualifies as life nor on what defines mind. Rather than taking up the much more difficult task of addressing the many different ways of explaining how life relates to mind, and vice versa, this paper considers two influential accounts addressing how best to understand the life–mind continuity thesis: (...) first, the theory of autopoiesis (AT) developed in biology and in enactivist theories of mind; and second, the recently formulated free energy principle in theoretical neurobiology, with roots in thermodynamics and statistical physics. This paper advances two claims. The first is that the free energy principle (FEP) should be preferred to the theory of AT, as classically formulated. The second is that the FEP and the recently formulated framework of autopoietic enactivism can be shown to be genuinely continuous on a number of central issues, thus raising the possibility of a joint venture when it comes to answering the life–mind continuity thesis. Ethical decision making measures are widely applied as the principal dependent variable used in studies of research integrity. However, evidence bearing on the internal and external validity of these measures is not available. In this study, ethical decision making measures were administered to 102 graduate students in the biological, health, and social sciences, along with measures examining exposure to ethical breaches and the severity of punishments recommended. The ethical decision making measure was found to be related to exposure to ethical (...) events and the severity of punishments awarded. The implications of these findings for the application of ethical decision making measures are discussed. (shrink)

Several philosophers have argued that the factivity of knowledge poses a problem for epistemic contextualism (EC), which they have construed as a knowability problem. On a proposed minimalistic reading of EC’s commitments, Wolfgang Freitag argues that factivity yields no knowability problem for EC. I begin by explaining how factivity is thought to generate a contradiction out of paradigmatic contextualist cases on a certain reading of EC’s commitments. This reductio results in some kind of reflexivity problem for the contextualist when it (...) comes to knowing her theory: either a knowability problem or a statability problem. Next, I set forth Freitag’s minimalistic reading of EC and explain how it avoids the reductio, the knowability problem and the statability problem. I argue that despite successfully evading these problems, Freitag’s minimalistic reading saddles EC with several other serious problems and should be rejected. I conclude by offering my own resolution to the problems. (shrink)
